Azienda Agricola Minnelea is also the owner and operator of the Website and the provider and manufacturer of the products sold online. 1. Our Business Policy

1.1 The Seller offers products for sale on the Website www.minnelea.com and operates e-commerce exclusively towards end consumers, who are considered as “Consumers”.

1.2 A “Consumer” is defined as any natural person who purchases on minnelea.com and whose purchases are not related to their business, commercial, or professional activity, and is therefore subject to the provisions of Legislative Decree No. 206/2005 (Consumer Code), particularly with respect to Chapter I of Title III of the said law. These General Sales Terms and Conditions therefore do not apply to online purchases made by businesses (B2B).

1.3 In accordance with its business policy, the Seller reserves the right to refuse orders from individuals who are not “Consumers,” persons under 18 years of age, or orders that do not align with its business policy.

1.4 These General Sales Terms and Conditions exclusively govern the offer, transmission, and acceptance of purchase orders for products on lagiardinieradimorgan.com between users of lagiardinieradimorgan.com and the Seller. These terms do not govern the provision of services or the sale of products by third parties through links, banners, or other hyperlinks on minnelea.com. 2. Contract Conclusion with the Seller - Purchase Guide

2.1 Consumers wishing to purchase one or more products on the Seller’s Website must submit an online order to the Seller. To do this, the buyer must access the “Shop” section of the Website and add the products they wish to purchase to the “Cart.” Once all desired products are added, the customer must access the “Cart” section to view the description of the added products, the subtotal price, shipping costs, and the total price. Here, the buyer can also remove any products mistakenly added to the cart. It is the buyer’s responsibility to verify the accuracy of the products entered in the cart.

2.2 To complete the order, the customer must click on the “Complete Order” button. Here, the buyer must correctly enter their personal information into the electronic forms.

2.3 To save their information for a future order, the customer can create a personal account by selecting the “Create Personal Account” option. The activation of a personal account is confirmed by sending an email to the provided address. Registration details may only be used by the registered user and not shared with third parties. The user must immediately inform Azienda Agricola Minnelea if they suspect misuse of their registration details. These credentials can be changed by the user at any time through the “My Account” section on the Website. In the “My Account” section, the user can also change their personal data, view various orders placed, and delete their account.

2.4 For reordering by a customer already registered on the Website, the buyer’s personal information will be automatically entered; in this case, it is up to the buyer to verify the accuracy of the entered data, confirm its authenticity, and make any necessary corrections.

2.5 It is expressly noted that any damages, delays, or inconveniences resulting from the incorrectness or inaccuracy of personal data entered during registration and/or later changes and/or submission of the order cannot be attributed to or blamed on the Seller in any way.

2.6 To proceed with the order, the payment method must be specified, choosing from those offered by the Seller, which are detailed in the following point 3 “Payments.” Before purchasing products, by sending the order form, it is requested to carefully read and print and/or save for personal use a copy of the General Sales Terms and Conditions (for purchasing a gift card, also the relevant terms of use). Similarly, the buyer must review the privacy policy before submitting the order. By submitting the order form, the user confirms that they are aware of and accept these General Sales Terms and Conditions, the gift card terms of use, and the privacy policy and agrees to abide by them. If the user does not accept any of the listed conditions, they are requested by the Seller not to submit the order.

2.7 By clicking the “Place Order” button, the customer sends the purchase order to the Seller, which entails the obligation for the buyer to pay the price specified in the order. The transmission of the order implies the buyer’s intent to enter into a purchase contract for the goods listed in the purchase order with Azienda Agricola Minnelea, which is governed by these General Sales Terms and Conditions as well as the specific provisions of the Consumer Code and involves the buyer’s obligation to make payment.

2.8 After receiving the order, the Seller will automatically send a confirmation email. This email will contain the order number and a summary of the purchased products, total price, payment method chosen, shipping method, estimated delivery times, delivery and billing address, as well as a reference to these General Sales Terms and Conditions and information on the right of withdrawal.

2.9 The order form is stored in the Seller’s database for the time necessary to process the order and, in any case, in accordance with legal provisions. The registered customer on the Website can access the order form through the “My Account” section.

2.10 The language for concluding the contract is Italian. The contract is concluded when the Seller receives the order form after electronic transmission, verifies the accuracy of the data, and sends the confirmation email as per the previous point 2.8. After the contract is concluded and the payment of the sale price is verified, the Seller will process the order and begin preparing it.

2.11 The Seller may not fulfill orders that do not provide adequate payment guarantees, are incomplete, incorrect, or not in line with its business policy or if the products are not available. In such cases, the Seller will notify the customer by email to the address provided by the consumer, informing them that the order cannot be fulfilled and stating the reasons. In the case of payment already made, the Seller will refund any amounts paid.

3. Prices and Payments

3.1 The sale prices of the products available on the Website www.minnelea.com are those indicated in the Shop section of the Website; however, they may be subject to change. The consumer must therefore verify the final sale price before submitting the order form.

For purchases on the Website www.minnelea.com, the following payment methods are available. However, the purchase of a gift card can only be made by credit card or bank transfer in advance.

Credit Cards

The Website minnelea.com accepts credit cards accredited by PayPal and Stripe. The purchase process can be canceled at any time without consequences.

Credit Card Security

If payment for goods purchased online on the Website minnelea.com is made by credit card, cards accredited by PayPal and Stripe are accepted. The Seller guarantees the protection of payment transactions, as the Website never stores the card number used for payment but only makes it accessible to the user’s requests for payment processing through the security protocols provided by the two mentioned payment providers. The payment is made through an encrypted channel. Payment security is guaranteed by the Secure Socket Layer (SSL) protocol. The Seller reserves the right to take appropriate action in the event of fraudulent attempts or the use of unlawfully possessed payment methods.

Bank Transfer

If payment is made by bank transfer, the transfer must be completed within 3 business days after the order is placed. After this period, the order may be automatically canceled without prior notice. Bank details for making the transfer are provided in the confirmation email sent to the buyer after the order.

Payments by Gift Cards

The use of gift cards purchased in the “Gift Cards” section of the Website is only possible for payment of the purchase price on minnelea.com and only if they are valid and not expired at the time of purchase. No refunds are given if the purchase price is less than the amount of the gift card. If the purchase price is higher than the amount of the gift card, the difference must be paid using one of the other available payment methods. Gift cards have a validity of 12 months from the date of purchase. Unused amounts expire after the validity period.

4. Shipping and Deliveries

4.1 Products are delivered to the address provided by the buyer. The Seller is not responsible for providing an incorrect delivery address. The delivery address may also differ from the billing address, which is only indicated at the buyer’s explicit request on the order form.

4.2 Shipping costs and estimated delivery times are specified in the “Shipping” section on the Website. Typically, products are shipped within the time frames indicated on the Website after the order is received, unless unforeseen circumstances arise or the order cannot be fulfilled due to force majeure.

4.3 In the event that delivery does not occur within the indicated time frames, the buyer will be notified by the Seller via email. In any case, the delivery time begins from the moment the products are handed over to the shipping company.

4.4 The buyer agrees to inspect the products at the time of delivery and confirm receipt. The buyer must sign the delivery note or document to complete the delivery. If the buyer notices that the products are damaged or incomplete, they may refuse the damaged products. In such cases, the buyer must immediately notify the Seller by email at info@minnelea.com and return the damaged product in the original packaging. Upon return, the Seller will promptly inform the buyer of the steps for a refund. The Seller is not responsible for damage to the products caused by improper handling after delivery or by incorrect use.

5. Right of Withdrawal

5.1 The consumer has the right to withdraw from the contract within 14 days of receiving the products without providing any reasons. Withdrawal must be made in writing via email to the Seller at info@minnelea.com, clearly indicating the intention to withdraw from the contract. For the deadline, the time of receipt of the email by the Seller is decisive. In the case of timely withdrawal, the Seller will refund the purchase price as well as the shipping costs. The refund will be made using the same payment method used by the buyer for the payment.

5.2 The buyer must return the products within 14 days after withdrawal to the Seller. The costs of returning the products are borne by the buyer. The products must be returned in the original packaging and in the same condition as when received. The Seller reserves the right to withhold the refund of the return costs if the returned products are damaged or not in perfect condition.

6. Warranty and Liability

6.1 Products offered on the Website are guaranteed in accordance with applicable legal provisions. For defective or faulty products, the buyer has the right to repair or replacement of the products or, if this is not possible, a refund of the purchase price. The buyer must inform the Seller within 2 months of discovering the defect.

6.2 The Seller is not liable for damages or losses directly or indirectly caused by the use of the products, unless such damages were caused intentionally or through gross negligence.

7. Changes to the General Sales Terms and Conditions

7.1 The Seller reserves the right to change these General Sales Terms and Conditions at any time. Changes will be published on the Website and will be effective from the day of publication. For orders placed before the date of publication of the changes, the previous terms remain in effect.

8. Governing Law and Jurisdiction

8.1 This contract is governed by Italian law. In case of disputes arising from this contract, the jurisdiction of the consumer's place of residence is applicable.
