1 Our trade policy

1.1 The Seller offers its products for sale on the Website www.minnelea.com and carries out its e-commerce activity exclusively towards its end users who are "Consumers".

1.2 When we speak of "Consumer" the reference is to any natural person who acts on minnelea.com for purposes not related to his commercial, entrepreneurial or professional activity possibly carried out, and, therefore, subject to the legislation referred to in Legislative Decree, no. 206/2005 (Consumer Code), with specific regard to Chapter I of Title III of Part III of the aforementioned legislation. These general conditions of sale, therefore, do not regulate online purchases made on the Site by entrepreneurs (so-called business to business).

1.3 In consideration of its commercial policy, the Seller reserves the right not to process orders from subjects other than the "Consumer", from subjects under the age of 18, or in any case to orders that do not comply with its commercial policy.

1.4 These Terms and Conditions exclusively regulate the offer, forwarding and acceptance of purchase orders for products on lagiardinieradimorgan.com between users of lagiardinieradimorgan.com and the Seller. 2 How to conclude the contract with the Seller - Buying guide

2.1 The Consumer Customer who wishes to proceed with the purchase of one or more products on the Seller's Website must proceed by sending a specific electronic order to the Seller. To proceed in this sense, the Purchaser must access the "Shop" section of the Site, and proceed with adding the Products he intends to purchase to the "Cart". 2.3 To allow personal data entered to be remembered for a subsequent order, the Customer has the option of proceeding with the creation of his own personal account by ticking the wording "Create personal account". The activation of a personal account will be confirmed by sending an e-mail message to the address indicated. The registration credentials must be used exclusively by the registered user and cannot be transferred to third parties. The user must promptly inform the Minnelea Farm. in case of suspected misuse of your registration credentials. These credentials may be modified by the user at any time by accessing the appropriate "My account" section on the Site. Furthermore, in the appropriate section, the User may modify his/her personal data entered, view the various orders placed and cancel your account.

2.4 In the event of a new order being sent by a Customer already registered on the Site, the Buyer's personal data will be entered automatically; in this case the Purchaser will have the burden of verifying that the data have been entered correctly, verifying their truthfulness and possibly correcting them.

2.5 It is therefore understood that any damage-delay-inconvenience attributable and/or attributable to the incorrectness and/or untruthfulness of the personal data entered at the time of registration and/or subsequently during the modification and/or sending of the order , cannot in any way be attributed and/or charged to the Seller.

2.6 To continue with the sending of the order, the user must indicate the means of payment chosen among those made available by the Seller and better specified in the following point 3) "Payments". If, on the other hand, some of the terms listed here are not shared by the user, the same is invited by the Seller not to proceed with sending the order.

2.7 By clicking on the appropriate wording "Place Order" the Customer will send the purchase order to the Seller, with the consequent obligation for the Buyer to proceed with the payment of the price as indicated in the order itself. In fact, sending the order implies for the Purchaser the will to conclude a sales contract concerning the goods listed in the purchase order, stipulated with the Minnelea Agricultural Company, governed by these General Terms and Conditions of Sale, as well as by the specific discipline dictated by the Consumer Code, and entailing the obligation to pay for the Purchaser.

2.8 Upon receipt of the order, the Seller will automatically send an email acknowledging the order. In this email the order number will be made available as well as a further summary of the Products purchased, with specific indication of the total price, the chosen payment method, the means of delivery and the estimated delivery times, the shipping address and billing, as well as a reference to these Terms and Conditions and information on the Right of Withdrawal.

2.9 The order form will be filed in the Seller's database for the period necessary to process the order and in any case in accordance with the law. The Customer registered on the Site can access the order form by consulting the "My account" section.

2.10 The language for concluding the contract is Italian. The contract is concluded when the Seller receives, electronically, the order form, after verifying the correctness of the relative data and accepts it by sending the order acceptance email referred to in point 2.8 above. Once the Contract has been concluded, and the payment of the sale price has been verified, the Seller will take charge of the order, proceeding with the preparation of the same.

2.11 The Seller may not process purchase orders that do not give sufficient guarantees of solvency or that are incomplete, incorrect, do not comply with its commercial policy, or in the event of unavailability of the Products themselves. In these cases, we will inform by sending an e-mail message to the address indicated by the Consumer that the Seller will not be able to process the purchase order specifying the reasons. In case of forwarding the order form and payment of the price, the Seller will refund the amount already paid.

3 Prices and Payments

The Consumer, therefore, before proceeding with the forwarding of the relative order form must take care to ascertain the final sale price.

The following means of payment are available for purchases on the www.minnelea.com website. The purchase of a Gift Card, however, can be made by credit card or bank transfer.

Credit cards

The credit cards accepted on the minnelea.com site belong to the circuits accredited by Paypal and Stripe. The purchase procedure can be interrupted at any time without consequences.

Credit card security

If payment for goods purchased online on the lagiardinieradimorgan.com website is made by credit card, cards belonging to circuits accredited by Paypal and Stripe will be accepted.

5 Right of withdrawal and repayment times and methods

5.1 The Purchaser, with the exception of the supplies of goods which are likely to deteriorate or expire rapidly, has the right to withdraw from the contract concluded with the Seller, without any penalty and without specifying the reason, within 14 days from the day of delivery of the product. In case of purchase of Gift Cards, the right of withdrawal can be exercised within 14 days of purchase.

5.2 All our products are pure and therefore may undergo natural color variations. This cannot become the subject of a product replacement request.

5.3 To withdraw from the contract, access the specific "right of withdrawal" section on the Website and fill in the relative online form provided for exercising the relative right of withdrawal. The Consumer must fill in the appropriate form following the instructions therein. Correct submission of the form will be confirmed by sending an e-mail message sent by the Seller to the address indicated by the Consumer. Alternatively, the Consumer may also exercise his right of withdrawal by sending an email to the Seller at ordini@minnelea.com, in which it will be mandatory to enter the order number you wish to return, possibly specifying which product you wish to return. exercise the right of withdrawal and, if deemed appropriate, the reason for the return (this information helps the Seller to provide a better service).

5.4 Once the aforementioned communication of withdrawal has been received, the Seller, having verified the correct exercise of the right of withdrawal, will send an opening email to the Consumer, containing the procedure to be followed for returning the products.

5.5 The burden of proof relating to the correct exercise of the right of withdrawal within the manner described above rests with the consumer.

5.6 Once the Right of Withdrawal has been exercised, the Purchaser must proceed, at his own expense, with the return of the purchased products, which must be returned sealed and intact, including the external packaging and/or casing containing the purchased product.

5.7 If the Right of Withdrawal is exercised following the methods and terms indicated, the Seller will refund any sums already collected for the purchase of the products according to the methods and terms provided. The sums will be refunded in the shortest possible time and, in any case, within fourteen (14) days from the date on which the Seller became aware of the exercise of your right of withdrawal, with the same payment methods chosen by the consumer for the initial transaction.

5.8 The Seller reserves the right to withhold the refund until he has received the goods or until the consumer has demonstrated that he has sent the goods back, depending on which situation occurs first.

5.9 Unless the Seller has offered to collect the goods himself, the Consumer must arrange for the return of the Products for which the right of withdrawal has been correctly exercised, without undue delay and in any case within fourteen days from the date on which he communicated to the Seller's own decision to withdraw from the contract. The costs for the return following the exercise of the right of withdrawal are borne by the Consumer.

5.10 The shipment, until the certificate of receipt in the Seller's warehouse, is under the complete responsibility of the Consumer. The seller is not liable in any way for damage and/or theft and/or loss of goods returned by uninsured shipments. In the event of damage to the goods during transport, the Seller will notify the Customer of the incident (within 5 working days of receipt of the goods in its warehouses), to allow him to file a complaint against the courier of his choice and obtain a refund of the value of the asset if insured. In this eventuality, the product will be made available to the Customer for its return at the same time as canceling the request for withdrawal.

5.11 What is specified in points 5.4, 5.6, 5.7, 5.8, 5.9 and 5.10 of this paragraph does not apply if the right of withdrawal is exercised with respect to the purchase of a Gift Card. 7 Applicable Law and resolution of disputes arising with the Consumer and competent court

7.1 These conditions of sale are governed by Italian law.

7.2 The Consumer Customer can make use of the tools for the out-of-court settlement of disputes on an electronic platform as provided for by articles 141 et seq. Legislative Decree 206/2005, or, in accordance with the Online Dispute Resolution (ODR) Regulation - Regulation (EU) No. 524/2013 of the European Parliament of 21 May 2013 - concerns the procedures aimed at resolving disputes between companies and consumers originating from contracts for goods and services entered into, by accessing the online ODR platform, which can be consulted at the website https://webgate.ec.europa.eu/odr.

9.3 For any dispute concerning the General Conditions, the Court of the place indicated by the user as his residence or domicile within the Italian territory will be competent.
