General Terms and Conditions of Sale

The offer and sale of the Products on the website minnelea.com (hereinafter also the "Site") are governed by these General Terms and Conditions of Sale. The products are sold directly by Azienda Agricola Minnelea (the "Seller"), with registered office at Via Serra 12 — 84060 Moio della Civitella (SA), Italy, registered with the Salerno Chamber of Commerce under no. VI-267918, VAT no. 06042760659 and Italian Tax Code RZZCMN78H30H501Z, PEC minnelea@pecaruba.it.

Azienda Agricola Minnelea is the owner and operator of the Site, as well as the Supplier-Producer of the products sold online. Any further information may be requested by writing to info@minnelea.com.

1. Our commercial policy

1.1 The Seller offers its products for sale on the Site minnelea.com and carries out its e-commerce activity exclusively towards end users who are "Consumers".

1.2 "Consumer" means any natural person acting on minnelea.com for purposes unrelated to any commercial, business or professional activity they may carry out, and therefore subject to Italian Legislative Decree no. 206/2005 (the Consumer Code), with specific regard to Chapter I of Title III of Part III. These General Terms and Conditions of Sale therefore do not govern online purchases made by business operators (business to business).

1.3 In view of its commercial policy, the Seller reserves the right not to process orders from persons other than the Consumer, from minors under 18 years of age, or otherwise not in compliance with its commercial policy.

1.4 These Terms govern exclusively the offer, submission and acceptance of purchase orders for products on minnelea.com between users and the Seller. They do not govern the provision of services or the sale of products by parties other than the Seller that may appear on the Site via links, banners or other hyperlinks. Before purchasing products or services from third parties, we recommend checking their terms of sale: the Seller is not responsible for the provision of services or for transactions concluded with third parties.

2. How to conclude the contract with the Seller — Purchasing guide

2.1 The Consumer Customer wishing to purchase one or more products must submit a corresponding electronic order to the Seller. To do so, they must access the "Shop" section of the Site and add the desired Products to the "Cart". In the "Cart" section, they can view the description of the Products, the subtotal price, the shipping costs and the total price, and remove any Products added by mistake. It is the Buyer's responsibility to verify that the Products added to the Cart are correct.

2.2 To submit the order, the Customer must click on "Complete order" and correctly enter their personal data in the relevant electronic forms.

2.3 The Customer may create a personal account to store their data for subsequent orders. Account activation will be confirmed by e-mail to the address provided. The registration credentials must be used solely by the registered user and may not be transferred to third parties. The user must promptly inform Azienda Agricola Minnelea of any suspected misuse of their credentials. The credentials and personal data may be modified at any time in the "My account" section, where the user can also view their orders and delete the account.

2.4 In the case of a new order placed by an already registered Customer, the data will be entered automatically; the Buyer will be responsible for verifying its accuracy and truthfulness and for correcting it where necessary.

2.5 Any damage, delay or inconvenience attributable to incorrect or untruthful personal data entered may in no way be charged to the Seller.

2.6 To proceed, the user must indicate the chosen payment method from those available (point 3). Before purchasing, the user will be asked to read these General Terms and Conditions of Sale carefully (and, for Gift Cards, the relevant General Terms of Use) and to review the privacy notice on the processing of personal data. By submitting the order form, the user confirms that they know and unconditionally accept these Terms, the Gift Card Terms of Use and the Privacy Policy. Anyone who does not agree with these terms is invited not to submit the order.

2.7 By clicking on "Place order", the Customer submits the purchase order to the Seller, with the consequent obligation to pay the indicated price. Submitting the order implies the intention to conclude a contract of sale for the indicated goods, governed by these Terms and by the Consumer Code, with an obligation of payment on the part of the Buyer.

2.8 Upon receipt of the order, the Seller will automatically send an acknowledgement e-mail containing the order number, a summary of the Products purchased, the total price, the payment method, the means and estimated delivery times, the shipping and billing addresses, as well as a reference to these Terms and to the information on the Right of Withdrawal.

2.9 The order form will be stored in the Seller's database for the period necessary to process it and within the terms of law. The registered Customer may consult it in the "My account" section.

2.10 The language for concluding the contract is Italian. The contract is deemed concluded when the Seller receives the order form electronically, verifies its correctness and accepts it by sending the acknowledgement e-mail referred to in point 2.8. Once the contract is concluded and payment verified, the Seller will proceed to prepare the order.

2.11 The Seller may not process orders that do not offer sufficient guarantees of solvency, that are incomplete or incorrect, that do not comply with its commercial policy, or in the event of unavailability of the Products. In such cases, it will give notice by e-mail to the address indicated by the Consumer, specifying the reasons, and will refund any amounts already paid in advance.

3. Prices and payments

3.1 The sale prices are those indicated in the "Shop" section of the Site and may be subject to updates. Before submitting the order, the Consumer must ascertain the final sale price.

3.2 For purchases on minnelea.com, the payment methods indicated below are available. A Gift Card may be purchased by credit card or advance bank transfer.

Credit cards. Cards belonging to the circuits managed by PayPal and Stripe are accepted. The purchase procedure may be interrupted at any time without consequences.

Payment security. The security of transactions when entering card data is guaranteed by TLS (Transport Layer Security) technology. Sensitive data reaches exclusively the payment service provider (PayPal/Stripe) responsible for receiving payments. No credit card data is transmitted to the site minnelea.com or stored in its archives. At the end of the procedure, a payment confirmation page will be displayed and the service provider will send the transaction receipt by e-mail.

5. Right of withdrawal, refund times and procedures

5.1 With the exception of the supply of goods liable to deteriorate or expire rapidly (for which withdrawal is excluded pursuant to art. 59 of the Consumer Code), the Buyer has the right to withdraw from the contract, without any penalty and without giving a reason, within 14 days of delivery of the product. In the case of the purchase of a Gift Card, withdrawal may be exercised within 14 days of purchase.

5.2 All our products are pure and may undergo natural variations in colour: this does not constitute grounds for requesting a replacement of the product.

5.3 To withdraw, the Consumer may access the "Right of withdrawal" section of the Site and complete the relevant online form following the instructions; correct submission will be confirmed by e-mail. Alternatively, withdrawal may be exercised by sending an e-mail to info@minnelea.com, mandatorily indicating the order number, any products for which withdrawal is exercised and, if desired, the reason for the return (useful for improving our service).

5.4 Once the withdrawal notice has been received and its correct exercise verified, the Seller will send the Consumer a return-opening e-mail with the procedure to follow for returning the products.

5.5 The burden of proof regarding the correct exercise of the right of withdrawal, in the manner described above, lies with the Consumer.

5.6 Once withdrawal has been exercised, the Buyer must return the purchased products at their own expense; they must arrive sealed and intact, including the outer packaging and/or wrapping.

5.7 If withdrawal is exercised within the terms and in the manner indicated, the Seller will refund the sums already collected for the purchase of the products as soon as possible and in any case within 14 days from the date on which it became aware of the exercise of withdrawal, using the same payment method chosen for the initial transaction.

5.8 The Seller may withhold the refund until it has received the goods or until the Consumer has demonstrated that they have returned them, whichever occurs first.

5.9 Unless the Seller offers to collect the goods itself, the Consumer must return the Products without undue delay and in any case within 14 days from the date on which they communicated the decision to withdraw. The return shipping costs are borne by the Consumer.

5.10 Shipment, until confirmation of receipt at the Seller's warehouse, is entirely the Consumer's responsibility. The Seller is not liable for damage, theft or loss of goods returned by uninsured shipment. In the event of damage to the goods during transport, the Seller will notify the Customer within 5 working days of receipt at its warehouses, so that the Customer can file a claim against the chosen courier and obtain any refund of the insured value. In such an event, the product will be made available to the Customer for return, simultaneously cancelling the withdrawal request.

5.11 The provisions of points 5.4, 5.6, 5.7, 5.8, 5.9 and 5.10 do not apply to withdrawal exercised for the purchase of a Gift Card. The terms applicable in that case are set out in the General Terms of Use of the Gift Card, available in the dedicated "Gift Card" section of the Site.

6. Privacy

6.1 Information on the processing of personal data is contained in the relevant privacy notice, available in the "Privacy Policy" section of the Site, to be considered an integral part of these General Terms and Conditions of Sale.

7. Applicable law, dispute resolution and competent court

7.1 These Terms of Sale are governed by Italian law.

7.2 The Consumer Customer may use the out-of-court dispute resolution tools provided for by articles 141 et seq. of Legislative Decree 206/2005 and, in accordance with Regulation (EU) no. 524/2013 (ODR) of the European Parliament of 21 May 2013, access the online ODR platform available at https://ec.europa.eu/consumers/odr.

7.3 For any dispute relating to these General Terms, the competent court shall be that of the location indicated by the user as their residence or domicile within Italian territory.
